This study examines values and value types as well as scores in levels of moral reasoning for␣students enrolled in a business program. These two factors are measured using the Schwartz Personal Values␣Questionnaire and the Defining Issues Test 2. No statistically significant differences in levels of moral␣reasoning, rankings of values, and value types could be attributed to gender. However, eight significant correlations between value types and levels of moral reasoning provide evidence that a systematic relationship exists. : This paper considers whether a physician is criminally liable for administering a dose of painkillers that hastens a patient's death. The common wisdom is that a version of the doctrine of double effect legally protects the physician. That is, a physician is supposedly acting lawfully so long as the physician's primary purpose is to relieve suffering. This paper suggests that the criminal liability issue is more complex than that. Physician culpability can be based on recklessness, and recklessness hinges on (...) whether a physician has taken an unjustifiable risk of hastening death. The authors identify three conditions of justifiability. Their analysis helps to explain the distinction between euthanasia, which is legally banned, and the use of risky analgesics, which is permitted in limited circumstances. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Criminal Law, Pain Relief, and Physician Aid in DyingFaye Girsh, Ed.D., Executive DirectorMadam:The article by Cantor and Thomas on “Pain Relief, Acceleration of Death, and Criminal Law” (KIEJ, June 1996) was a tortured attempt to develop criteria for the humane and compassionate physician who tries to serve the needs of a patient in unremitting pain. There are three areas that merit comment.The authors dealt with pain medications that might (...) have the undesirable side effect of causing death. They did not mention tolerance, which usually occurs in a patient with chronic pain and which would require exceedingly high doses to be effective. They did not mention barbiturates, which are preferable to opiates in causing death and which are used increasingly by compassionate physicians to answer the pleas of their suffering patients, but for which there is no excuse about alleviating pain. Would the criminal law just call the prescription of a lethal dose of barbiturates a reckless act and require conviction? Fortunately, juries, as the authors point out, do not balance these formulas on the head of a pin. When they see the circumstances under which these doctors do help their patients, they choose to nullify the law and would ignore the suggestions made in this article.The authors refer to the “consent” of the patient. They do not mention that these doctors are operating with more than consent; they are administering these medications because suffering patients are begging them to put them out of their pain and the indignities of the dying process. The article discusses the process as though it were the same as consent to elective surgery. These patients—with AIDS, cancer, and hopeless neurological degeneration—are not simply agreeing to a procedure; they are desperately seeking a way out. If the criminal law were to develop criteria for physician aid in dying, certainly one of them should be the active, witnessed, repeated request of such a patient for a certain, quick, painless, gentle death.The third point is that physicians do not face prosecution when administering no treatment to a patient whose life could be saved with treatment but who chooses not to receive it. This has been upheld by the U.S. Supreme Court; no criteria for suffering, alternatives, terminality, justifiability, or unbearability are required. The doctor can stand by while the patient dies what may be a protracted, difficult death, but it is within the law. What matters in this situation is the decision of the patient to refuse treatment, and that is absolute. How ironic that the patient who cannot refuse treatment must, with his or her doctor, jump through all these hoops to achieve a peaceful death.One worries that the physician who must balance the risk of “risky pain relief” against the accusation of recklessness will err in the direction of allowing [End Page 103] the patient to bear the pain rather than help with a dose of analgesics that might be considered beyond the stipulated “risk.”Why don’t we just be honest about it? Allow dying or hopelessly ill patients to make the decision about what they want by passing a carefully defined law allowing euthanasia rather than balancing the risk and trying to determine the “purpose” of the physician’s ministrations. We protect some patients from themselves while allowing others almost complete autonomy to make the choice of ending their lives. George Santayana was one of the leading philosophers of his era. In what follows I have, of course, presupposed a knowledge of Sternbach's work which has happily rendered superfluous the new text which he was to have edited for Methuen's Series of Byzantine Texts.

I believe that Mr. Sosa is right about my example but wrong on the substantive issue; which shows that my example was poorly chosen. If the ugliest Irishman was so ugly that even the Irish were offended, they might form a committee to get rid of him. Suppose he was kidnapped and deposited in New York. If we were informed of all this and also knew that the ugliest Irishman is the Prime Minister, I agree that we should have been (...) given an adequate explanation of why the Prime Minister is in New York. "In his study of Philo Mr. Bentwich has done good service by demonstrating this characteristically Jewish combination of qualities in the spirit of the great Alexandrine, and by vindicating the claim of Philo to rank among the great teachers of Judaism." -The Jewish Review "Philo, the chief light of Hellenistic Judaism, by a strange fate was rejected and forgotten by his own people, while he was taken up by the Christians and almost adopted as one of their own. This difference (...) of attitude towards him on the part of Jews and Christians is easily explained. Who was the author of the Fourth Edict in the great persecution of Diocletian's reign we do not know. Its precise terms are not recorded; of the date of its issue we are not informed. It is true that Mr. Kidd has recently written: ‘On April 30, 304, Maximian put out the Fourth Edict in the name of himself and bis co-Augustus,’ but he discreetly forbears to give the reader any hint of the source on which he bases that statement. (...) It may be doubted whether he has any better authority in mind than the ambiguous Passio S. Sabini, which, as even Mr. Mason admitted many years ago, ‘is not in the highest class of the historical relics of its age.’ If, indeed, this supposition does not do Mr. Kidd an injustice, it would have been well to have given some reasoned defence of the document. Dufourcq regards the Passio S. Sabini as a product of the Ostrogothic period, and contends that its picturesque exordium does not depend upon any earlier source. Until his detailed criticism of the Passion is answered, we can hardly use it for the reconstruction of the history of the fourth century. (shrink)

Here is the final volume of Norman O. Brown's trilogy on civilization and its discontents, on humanity's long struggle to master its instincts and the perils that attend that denial of human nature. Following on his famous books _Life Against Death_ and _Love's Body_, this collection of eleven essays brings Brown's thinking up to 1990 and the fall of Communism in Eastern Europe. Brown writes that "the prophetic tradition is an attempt to give direction to the social structure precipitated (...) by the urban revolution; to resolve its inherent contradictions; to put an end to its injustice, inequality, anomie, the state of war... that has been its history from start to finish." Affiliating himself with prophets from Muhammad to Blake and Emerson, Brown offers further meditations on what's wrong with Western civilization and what we might do about it. Thus the duality in his title: crisis and the hope for change. In pieces both poetic and philosophical, Brown's attention ranges over Greek mythology, Islam, Spinoza, and _Finnegan's Wake_. The collection includes an autobiographical essay musing on Brown's own intellectual development. The final piece, "Dionysus in 1990," draws on Freud and the work of Georges Bataille to link the recent changes in the world's economies with mankind's primordial drive to accumulation, waste, and death. This paper explores Bakhtin’s reception of Goethe’s Wilhelm Meisters Lehrjahre with a view to assess how Bakhtin’s interest in this early chronotopical masterpiece can be understood in the wider context of his utopian thinking and his political eschatologies. Bakhtin reads Goethe’s novel as a critique of totalitarian forms of Socialist Realism as well as Dostoyevsky’s bourgeois realism. Like his contemporary Ernst Bloch, Bakhtin praises the complexity and richness of Goethe’s concept of realism. In the wake of Hermann Cohen, Georg Simmel (...) and Friedrich Gundolf to whom Bakhtin alludes and whom he quotes, Goethe is regarded as a modern literary and anthropological role model, the epitome of Bildung. For Bakhtin, Goethe’s and Rabelais’ writings about the carnivalesque constitute complementary forms of reflection of and agents for social and cultural transformation in modernity. (shrink)

In the history of philosophy, two standard critiques of the reality of modes in Spinoza’s philosophy come from Pierre Bayle and Georg Wilhelm Hegel. Both philosophers in some way assume that attributes and relations among modes constitute a shared reality in which modes participate. As a result, they assert that Spinoza’s monism leads either to an over-identification of God with contingent modes or to a limited God. In this paper, I will show how attributes and relations among modes in Spinoza’s (...) work simply explain an active modal reality; modes do not depend upon or participate in ideal relations and attributes for their existence. The result is that in Spinoza’s philosophy attributes must be seen as unreal and modal reality must be understood as primary. (shrink)

A consideração histórica descontinuísta do desenvolvimento de conceitos científicos e a classificação da técnica enquanto prótese do organismo vivo, entre outras particularidades, situam o pensamento canguilhemeano na fronteira entre áreas do conhecimento demarcadas separadamente. O que integra e individualiza o seu trabalho filosófico é a ponderação do vital enquanto categoria de base para intelecção e reconstrução de problemas (...) interdisciplinares. Após indicar o posicionamento de Canguilhem dentro do quadro da filosofia francesa do século XX, o artigo procura demonstrar de que maneira a função de regulação é um dos pilares organizadores do pensamento do “vivo” em sua obra.
